About the role:

We are seeking an In-House Lawyer with extensive experience in the retail or cosmetics industries to provide legal guidance and support across various areas of our business operations. The ideal candidate will have a strong understanding of industry-specific regulations (FDA, TGA, AICIS, Medical device standards etc.), intellectual property, advertisement law, contracts, intellectual property, compliance, and litigation matters.

This candidate would work with our internal legal team to establish our product and regulatory compliance setup, whilst also working with advertisement law and contract law on a global scale.

Other key roles will include overseeing internal legal matters which arise amongst a dynamic and rapidly growing company that operates on a global scale.

The overarching goal for this individual is to deliver accurate and timely legal advice to ensure the company and its stakeholders are legally protected.

Main duties and responsibilities:

Ensure Compliance with Industry-Specific Regulations:

  • Stay abreast of regulations governing the oral care industry, including FDA regulations, advertising standards, product labeling requirements, and safety standards to ensure Compliance with Industry-Specific Regulations..
  • Develop and implement compliance programs to ensure adherence to regulatory requirements across all aspects of the business, with a particular focus on oral care industry regulations and global expansion efforts.

Provide Legal Guidance for Product Development and Global Expansion:

  • Advise on legal implications of new product development, including regulatory requirements for ingredient safety, efficacy claims, and labeling.
  • Support global expansion efforts by providing legal guidance on market entry strategies, distribution agreements, and compliance with local regulations in target markets.

Mitigate Legal Risks and Dispute Resolution:

  • Identify and assess legal risks associated with business activities and provide proactive advice to mitigate risks.
  • Manage disputes and litigation matters, including product liability claims, intellectual property disputes, and contractual disputes.
  • Handle disputes related to advertising claims, false or misleading advertising, and competitor challenges, including responding to cease and desist letters, negotiating settlements, and representing the company in regulatory proceedings or litigation

Support Regulatory Compliance Programs:

  • Collaborate with cross-functional teams to develop and implement regulatory compliance programs, training materials, and standard operating procedures.
  • Conduct internal audits and assessments to ensure ongoing compliance with regulatory requirements.

Stay Informed About Industry Trends and Best Practices:

  • Monitor developments in the oral care industry, including emerging trends, regulatory changes, and competitive landscape.
  • Provide insights and recommendations to senior management based on industry analysis and best practices.

Provide Legal Training and Support:

  • Develop and deliver training programs to educate employees on legal issues relevant to their roles, including compliance with industry regulations and company policies.
  • Conduct training sessions for marketing teams and other stakeholders on advertising compliance requirements, best practices, and emerging issues in advertising law to promote a culture of legal compliance within the organization.
  • Provide legal support and guidance to internal stakeholders, including R&D, marketing, sales, and regulatory affairs teams.

Build and Maintain External Relationships:

  • Establish and maintain relationships with external legal counsel, regulatory agencies, industry associations, and other stakeholders.
  • Represent the company in industry forums, trade associations, and regulatory meetings.

Ensure Ethical Conduct and Confidentiality:

  • Uphold the highest ethical standards and promote a culture of integrity and compliance within the organization.
  • Maintain strict confidentiality regarding sensitive legal matters and proprietary information.

Advertising Compliance Assurance:

  • Review and approve advertising materials to ensure compliance with advertising laws and regulations, including claims substantiation, comparative advertising, and disclosures, while also considering industry-specific advertising standards.

Mitigation of Legal Risks in Marketing:

  • Advise marketing teams on legal risks associated with advertising campaigns, promotions, and product launches, ensuring compliance with consumer protection laws, industry standards, and advertising regulations.

Monitoring Regulatory Changes:

  • Stay informed about developments in advertising laws and regulations, consumer protection laws, and industry guidelines, and provide timely advice on adapting advertising strategies and practices accordingly.

Endorsement and Influencer Agreement Review:

  • Review and negotiate endorsement and influencer agreements to ensure compliance with disclosure requirements and guidelines set forth by regulatory authorities, such as the Federal Trade Commission (FTC).

Collaboration with Regulatory Affairs:

  • Work collaboratively with regulatory affairs teams to ensure alignment between advertising practices and regulatory submissions, approvals, and compliance obligations, particularly concerning product labelling, packaging, and marketing materials
  • Creating relations of trust with regulatory bodies

Implementation of Compliance Programs:

  • Develop and implement compliance programs and internal policies related to advertising practices, including review processes, approval workflows, and monitoring mechanisms, to uphold legal and ethical standards in advertising activities.

External Counsel Management:

  • Oversee relationships with external legal counsel specializing in advertising law matters, including selecting appropriate counsel, managing budgets, and ensuring effective communication and collaboration on legal projects and initiatives.

Industry Advocacy Participation:

  • Participate in industry associations, working groups, and forums focused on advertising law, consumer protection, and oral care industry issues, advocating for the company's interests and influencing the development of relevant laws, regulations, and industry standards.

Working with the internal legal team:

  • Liaising with other in-house lawyers within the organization to ensure we maintain an efficient and productive legal team.
  • Leadership: Theability to direct and motivate other team members to achieve company goals.
  • Communication: The ability to communicate clearly and concisely, varying communication style depending upon the audience.
  • Attention to detail: Excellent attention to detail and written skills when communicating with others, both internally and externally.
  • Commerciality: The ability to apply knowledge in a practical, commercial manner.
