We value those with sharp, analytical minds and are open to challenging the way things are done.Our teamASIC's Enforcement and Compliance Group (ECG) is responsible for the conduct of ASIC's initial inquiries, compliance, and enforcement work across a range of sectors. In 2022-23, more than 130 new investigations were commenced and enforcement actions resulted in 35 criminal convictions and almost $190 million in civil penalties and fines imposed by the courts. As one of ASIC's largest business groups, Enforcement and Compliance is constantly working on a variety of new and interesting projects and priorities, meaning that opportunities to join the team are frequently arising across our various teams.The roleAs a Senior Lawyer, you will take a leading role in investigations of suspected misconduct and obtaining enforcement outcomes. You will have the opportunity to participate in varied, interesting, and impactful work. More specifically, you will be relied on to:Guide the development of investigation strategy as well as the scoping, planning, and conduct of the investigation.Take a leading role in the preparation and compilation of criminal, civil, and administrative briefs and provide support to any proceedings in State or Federal Courts (IEA only).Take a leading role in commencing enforcement action including civil litigation, criminal prosecution, and administrative action.Additionally, you will be expected to:Identify and address complex legal issues arising during investigations.Provide advice about evidentiary requirements and the use of ASIC's statutory powers.Work as part of multi-disciplinary enforcement teams to project-manage matters and manage resources.Employ a range of evidence gathering techniques, including conducting compulsory examinations, interviewing witnesses, participating in the execution of search warrants, taking witness statements, preparing affidavits, and issuing compulsory notices.Utilise ASIC's evidence management technology and other systems to derive insights from data, information, and documents.Prepare and compile criminal, civil, and administrative briefs and provide support to any proceedings in State or Federal Courts (IEA only).Prepare administrative briefs for consideration by an ASIC Delegate and provide support to any administrative hearings.Contribute to commencing enforcement action, including civil litigation and criminal prosecution, and provide support to any proceedings in State or Federal Courts.Experience in the conduct of complex civil litigation or criminal matters is necessary for lawyers in the IEA teams. Experience in industries regulated by ASIC, including superannuation, insurance, credit, banking, wealth management/financial advisory, or insolvency will also be well regarded.About youAs the ideal candidate, you will be inquisitive, have an analytical mindset, and be comfortable working with complex information in a changing environment. With a consultative and collaborative interpersonal style, you will enjoy working as part of a large, multi-skilled team.In addition, you will have:Legal qualifications and a current practicing certificate.Significant, senior experience involving investigation, case/project management, and the conduct of civil litigation and/or preparation of criminal briefs of evidence.Experience in the conduct of complex litigation.An understanding of the law, practice, and policy relating to the Corporations Act, the National Consumer Credit regime, the ASIC Act, and other relevant financial services legislation.Demonstrated ability to use digital investigative tools.Highly developed written and verbal communication and stakeholder management skills.Experience in guiding and coaching other team members.A passion for using your legal skills to make a positive difference for investors and consumers in the Australian financial system.To work with us, you need to be an Australian citizen and be prepared to complete an ASIC Suitability and Baseline Assessment which is issued by ASIC's Security team.What we offer youASIC invests in their people and values a strong cultural environment.
