Position Overview The position of Member Advisor is one which assists the members of the NNTT and where instructed the President and/or the Registrar, in the discharge of their functions and powers under the Act including future act application management, mediation, post-determination assistance and re-consideration of registration test decisions. The primary role of the Member Advisor is to work directly with a member of the NNTT, providing high level support in relation to the range of work undertaken by members. Under the supervision of the Manager, Mediation, this position provides dedicated legal, research and administrative support to NNTT members, often working with confidential material and under limited direction for extended periods. The Member Advisor works closely with a member/s and other NNTT teams to provide all aspects of support required for the discharge of the NNTT statutory functions. Key Duties and Responsibilities The Member Advisor will play a key role in providing high level support to the members in preparing for mediations, hearings, inquiries and arbitration. They may also conduct mediations or co-mediate subject to approval from the member. Liaise with the other NNTT Teams (as required) to facilitate administrative, research and secretarial support required for the member. Develop and maintain a professional knowledge of legislative frameworks, case law, decision‑making processes, guidelines and regulations relevant to the work of the NNTT and the Registrar under the Act. Alert internal stakeholders of important changes in case law, legislation or policy that may impact upon the work of the NNTT or the Registrar as directed by the member or supervisor. Apply approved records and information management practices in compliance with the NNTT Records & Information Management Policy and Procedures. Support the Director, Dispute Resolution and the Director, Legal and Compliance, in providing legal support and advice to members, the President, and the Registrar as required. Provide support to the Director, Legal and Compliance in relation to Federal Court proceedings involving decisions of the member. Prepare documentation, including briefs, research papers, presentations, submissions, reports, conference papers, academic articles, policies and procedures, either independently or as part of a small team as required. Conduct high level legal research, providing quality written work in relation to native title and related issues, as required by member/s. Work with a high level of independence, setting priorities and managing competing workloads to ensure quality and timely outputs. Build and sustain effective working relationships with a network of key people internally and externally to achieve organisational goals and support members in the delivery of their statutory functions. Note: Tasks and duties of the role may change from time to time, subject to operational needs. Some travel will be required, possibly to remote locations. Selection Criteria Possessing and demonstrating an understanding of the issues affecting Aboriginal and Torres Strait Islander people. Possessing and demonstrating an ability to communicate sensitively with Aboriginal and Torres Strait Islander people. Proven ability to work independently, and as part of a team, while managing a variety of tasks to achieve results and meet deadlines. Well‑developed written communication and legal research skills with an ability to interpret and apply policies and procedures within a legislative framework. Proven ability to exercise good judgement and common sense and maintain high‑level professionalism and discretion in handling confidential information. Demonstrated knowledge of the legislative framework, case law, decision‑making processes, guidelines and regulations relevant to the work of the NNTT and the Registrar under the Act. Demonstrated professionalism, including the ability to work closely with one key stakeholder while simultaneously working constructively with a wide range of other stakeholders. Well‑developed verbal and interpersonal skills to manage complex relationships whilst operating within the boundaries of organisational processes and constraints. Other Requirements Legal qualifications, admission as a legal practitioner, or the eligibility to be admitted, is not essential, but beneficial and highly regarded.
