Der Ausschuss für bürgerliche Freiheiten, Justiz und Inneres (LIBE) des EU-Parlaments hat den Entwurf eines Entschließungsantrags zur Angemessenheit des durch das EU-US Data Privacy Framework (DPF) gewährten Schutzes veröffentlicht.
**Was besagt der Entschließungsentwurf zum Data Privacy Framework?**:
Der Entwurf kommt zu dem Schluss, dass das DPF nicht das angemessene Schutzniveau bietet, das das EU-Datenschutzrecht in der Auslegung des Europäischen Gerichtshofs verlangt, und fordert die Kommission auf, die Angemessenheitsentscheidung nicht anzunehmen und die Verhandlungen mit der US-Regierung fortzusetzen.
In seiner Argumentation greift der Entwurf die von mehreren Datenschutzbehörden und Datenschutzgruppen geäußerten Bedenken auf:
- Die Grundsätze der Verhältnismäßigkeit und der Erforderlichkeit werden in den Gesetzen der EU und der USA unterschiedlich definiert und ausgelegt;
- Die US Executive Order (EO) verbietet nicht die Massenerfassung von Daten durch öffentliche Behörden;
- Die EO gilt nicht für Daten, auf die Behörden auf anderem Wege zugreifen, z. B. durch den US Cloud Act oder den US Patriot Act, durch kommerzielle Datenkäufe oder durch freiwillige Vereinbarungen zur gemeinsamen Nutzung von Daten;
- Das Rechtsbehelfsverfahren sorgt nicht für ausreichende Transparenz und Unparteilichkeit;
- Im Gegensatz zu allen anderen Ländern, die Angemessenheitsentscheidungen im Rahmen der DSGVO erhalten haben, gibt es in den USA kein Bundesdatenschutzgesetz;
- Das EO kann jederzeit vom US-Präsidenten geändert werden;
- EU-Unternehmen verdienen Rechtssicherheit, während Datenübertragungsmechanismen, die rechtlich angefochten und aufgehoben werden können, zu anhaltender Unsicherheit und zusätzlichen Kosten führen.
**Was sind die nächsten Schritte auf dem Weg zur Angemessenheitsentscheidung?**:
Zwischen der Annahme des Entwurfs des Entschließungsantrags durch den Ausschuss und der Abstimmung im Plenum können einige Wochen bis mehrere Monate vergehen.
Die endgültige Abstimmung im Parlament wird Berichten zufolge für Mitte April erwartet, während die separate, nicht bindende Stellungnahme des EDPB, die wahrscheinlich ebenfalls kritisch gegenüber dem DPF ausfallen wird, sogar noch früher angenommen werden dürfte.
Stimmt eine qualifizierte Mehrheit der EU-Mitgliedstaaten für die Angemessenheitsentscheidung, könnte dieser frühestens im Juli fertiggestellt werden.
All dies ist ein weiterer deutlicher Hinweis darauf, dass die Rechtsunsicherheit für Unternehmen in Bezug auf den transatlantischen Datenverkehr bestehen bleibt, selbst wenn ein möglicher Angemessenheitsbeschluss schließlich angenommen wird.
