Background:
The Independent Media Commission (IMC) serves as the enduring regulatory body for audio-visual media, established with support from the OSCE Mission in Kosovo, aligning with European standards to maintain independence from political influences, as stipulated by its governing law and the Constitution. The IMC is a recognized member of the European Platform of Regulatory Authorities (EPRA).
The IMC operates as a constitutionally protected independent entity tasked with overseeing, regulating, and allocating resources within the Broadcast Frequency Spectrum in Kosovo. It is responsible for issuing broadcasting licenses and fostering the growth of professional media alongside the promotion of freedom of expression. The IMC comprises three main components: The Office of the Chief Executive, The Council (the decision-making body), and the Media Appeals Board.
Currently, the IMC oversees the licensing and regulation of 84 radio and television stations, as well as cable service providers. A significant aspect of the IMC's role involves educating the public about its regulatory functions, adherence to ethical standards, and raising awareness on critical issues such as gender equality, misinformation, and other forms of unethical reporting.
The Media Section is tasked with assisting the IMC in drafting a new regulation concerning a special fund aimed at promoting media pluralism, in accordance with the IMC law. This initiative will support media initiatives and licensed entities in various sectors, including education, democracy, arts, sports, and economic development. Additionally, the Media Section will aid the IMC in aligning the Code of Ethics for Media with the IMC law, ensuring partial harmonization with the EU Directive on Audio-visual Media Services (AVMSD). To facilitate this process, the Media Section will engage an international consultant.
Objective of Assignment:
To assist the IMC in revising its bylaws concerning the IMC Code of Ethics for Media and to formulate a new regulation regarding the special Fund for Media Pluralism, ensuring compliance with the updated IMC law and the European Union Audio-Visual Media Services Directive.
Duration of Assignment:
The Consultant will be engaged for a total of 20 working days.
Tasks and Responsibilities:
- Examine the new IMC Law and the applicable bylaws, providing insights and recommendations for necessary amendments;
- Ensure that the bylaws are consistent and aligned with the EU Audio-visual Media Services Directive (EUAVMSD);
- Engage with representatives of the Independent Media Commission to discuss and coordinate amendments as needed;
- Maintain communication with the MS Project/Activity Manager throughout the consultancy period;
- Deliver a comprehensive final report that includes analysis and recommendations regarding the bylaws.
Deliverables:
- Detailed recommendations for drafting and amending the bylaws (to be submitted within the agreed timeframe);
- Successful harmonization and drafting of IMC bylaws in accordance with EUAVMSD;
- Effective collaboration with IMC to meet their expectations throughout the consultancy;
- Consistent coordination with the MS Project/Activity Manager;
- Final report submission.
Necessary Qualifications:
- Advanced degree in law, media studies, political science, journalism, or a related social science discipline;
- A minimum of 7 years of experience related to international standards on freedom of expression, media freedom, and best practices in audio-visual media regulation;
- In-depth knowledge of EU media regulation frameworks;
- Ability to provide constructive feedback;
- Fluency in English;
- Experience working with international organizations.
Remuneration Package:
Compensation will be determined based on the qualifications and experience of the selected consultant, as well as the agreed-upon work plan, in accordance with current OSCE consultancy rates.
